Case called for hearing on admission and IA on 21.01.2025. Senior Counsel Sri. C.K. Nandakumar appeared for petitioner on behalf of Ms. Nishtha Kumar, for Trilegal Advocates, made submissions for return of Performance Bank Guarantee on termination of PPA owing to force majeure in terms of Regulation 5.7.1. and 5.7.4 of PPA. Senior counsel further submits that since, the Hon’ble High Court of Karnataka granted interim stay in WP No. 9137/2020 on encashing of PBG and the said writ petition was dismissed on 04.11.2024 for non-compliance of office objection and the present petition is filed on the basis of liberty given by this Commission’s order dated 10.01. 2024 in OP No. 43/2020 and prays for an ex-parte interim stay against encashing the Performance Bank Guarantee by the respondent and for directions to the Respondent not to take any coercive action against the same till the petition is disposed. Counsel Ms. Vismaya Simha for Just Law present for Respondent (BESCOM) and prays three weeks’ time to file statement of objections to both IA and main petition. Commission heard the counsels, admitted the petition and directed the Respondent not to encash the Performance Bank Guarantee till the disposal of this petition. Further directed the registry to register this petition as ‘original petition duly numbered’ instead of treating as Misc. petition. Call on 11.03.2025.
