Case is called for arguments on 01.08.2023. Counsel for petitioner Sri. Siddaveer Chakki for Navayana Law Offices present and filed memo dated 13.07.2023. Counsel for R-1 & R-2 Ms. Swetha Ranjan and counsel Ms. Stephania Pinto for R-3 present. Both petitioner and respondent counsels made their oral submissions/arguments and counter arguments both on facts/events and merits of the case and concluded. Commission heard the petitioner and respondent counsels, perused all relevant documents and noted that the renewal of WBA agreement is entered into between all necessary parties with due signatures affixed on the agreement on 15.04.2020 well within one day before expiry of WBA dated 17.04.2010. Hence, directed the parties to follow the terms and conditions of the renewed agreement dated 15.04.2020. The period of six months mentioned at Article 6.2.1 of the WBA dated 15.04.2020 has been set aside by the Hon’ble APTEL and Annual Banking is allowed. Further, it is ordered that if any un-utilised energy from April 2021 to December 2021, the respondent is directed to pay at 85% of the applicable generic RE tariff as determined by the Commission as on the date of renewed WBA on verification of the Data submitted by the petitioner, accordingly, the case is disposed.
