Case is called for hearing on 22.08.2023. Counsel for petitioner Sri. Manmohan P.N. present and made oral submissions on the tariff order 2023 of the Commission on the point of levying Additional Surcharge without any justification by the Respondent. Party-in-person Sri. K.S.Ramanujam, Manager, Mangalore SEZ present, submits that the question of levying Additional Surcharge arises only when the consumer is availing open access within the limits of the distribution licensee and in the present case, no such Additional surcharge levied on the petitioner and hence the question of levying Additional surcharges does not arise and prays to dispose the present petition. Commission heard both the counsels and took note of the statement of the Respondent, as on date of filing of the petition, the petitioner has not aggrieved by any demand from the SEZ. Commission also took note of the same and disposed the case accordingly.

Case is called for hearing on 25.07.2023. Counsel for petitioner Sri. Yogish present. Party-in-person Sri. K.S.Ramanujam, Manager, Mangalore SEZ Limited present, filed reply to the Review Petition dated 25.07.2023 and prays to take the same on record. Both counsel and party-in-person made oral submissions on the merits of Review Petition. Commission heard both parties, noted that in view of the directions from the Hon’ble high Court of Karnataka, Bengaluru Bench, Commission has scheduled a public hearing in respect of similar issue in levying Additional surcharge on the open access consumers in the tariff order 2023-24. Hence, Commission observed that both parties can come up before the public hearing scheduled to be held on 18.08.2023 at 11.00 A.M. in Commission office for discussion. Call for further hearing on 22.08.2023.
