Case called for arguments on 19.11.2024. Counsel for petitioner Smt. Sushma Nagaraj present, addressed arguments with relevant citations and prays for payment of interest as per present MCLR and 5% additional interest on it in the absence of MTLR. Counsel for Respondent Sri. Rohit Tiwari present, made submissions on the rate of interest to be calculated and prays time to address the issue. Commission heard both counsels and as no considered opinion/methodology is forthcoming from the parties in the absence of MTLR, Commission suggested both the parties to chalk out the alternative methodology to calculate the interest and to negotiate the rates by holding a joint meeting on 27.11.2024 in the office of BESCOM, Corporate Office, Bengaluru and arrive at methodology to calculate the interest agreeable to both parties and to file the Draft amendment of PPA before the Commission within one week thereafter. Respondent-BESCOM is hereby directed to make necessary arrangements for holding of joint meeting on 27.11.2024 in the Corporate Office. For compliance, Call on 10.12.2024.

Case called for arguments on 22.10.2024. Counsel for petitioner Ms. Manasi Kumar present, filed citations along with relevant data and prays to take the same on record. The counsel further made reliance to Article 6.3 of PPA wherein MTLR to be applied for delay in payment of bills. Presently in the absence of MTLR, any other rate that substitutes MTLR to be applied. Accordingly, PLR or MCLR + 5% to be calculated for payment of LPS and prays to pass orders accordingly. Counsel Sri. Rohit Tiwari present for Respondent on behalf of Ms. Swamini Mohanambal and prays time to revert back to the commission with further submissions on MTLR. Commission heard both counsels.
