Respondents COMMON ORDER: Petitioners who claim to be the landless poor residing in Gadwal Town and eking out their livelihood as daily wage workers, state that the erstwhile Government of Andhra Pradesh allotted small portions of land measuring 80 square yards each in Survey Nos.
968, 969, 979, 980, 983, 984 and 985 of Gadwal Town and patta certificate bearing No.
5659 dated 21.12.2013 was issued, duly handing over peaceful vacant possession of plots as house site for construction of a dwelling house therein.
Petitioners, it is stated, have been in 15 peaceful possession and enjoyment of the same for a span of approximately ten years.

While the matter stood thus, in December, 2021, it is stated, government sought to dispossess petitioners as they intended to construct a hospital and a nursing college in the said area.
Petitioners contend that though government acquired Acs.10.00 of land, it is now seeking to acquire the subject land.
Aggrieved thereby, petitioners approached Human Rights Commission and filed HRC Case No.
6179 of 2021 wherein the Commission granted status quo with regard to the nature of land and directed the District Collector, Jogulamba Gadwal to submit a report.
In compliance therewith, the District Collector submitted report dated 05.01.2022 stating that the plots of land which were meant for dwelling houses are required for construction of a 350-bedded hospital and a nursing college. g college.
The report further suggested that petitioners may apply for two- bed room flats under the 2BHK Housing Scheme of the Government of Telangana noting that the project is under progress.
The Collector also brought to the Commission’s notice availability of a large tract of land, measuring Acs.10.66 for construction of hospital and nursing college as informed by the 16 Medical Superintendent of the Area Hospital on submission of an Application under RTI Act.

It is further contended that despite the order of status quo, respondent authorities performed ‘Bhoomi Pooja’ on 11.06.2022 for proceeding with construction work by dispossessing petitioners from the subject land.
Challenging the said action, petitioners are before this Court.

This Court, taking into consideration the submission of learned counsel that in similar circumstances, interim order dated 04.07.2022 was passed in Writ Petitions No.
27857 and 27859 of 2022, directed status quo obtaining as on that day to be maintained until further orders.

Learned Government Pleader for Medical & Health on behalf of Respondents 2 and 3 submits that respondents have already constructed a 350-bedded hospital by following due procedure.

Recording the said submission, these Writ Petitions are disposed of directing respondents, either to allot 2 BHK houses or in the alternative, allot 80 square yards plots to each of the petitioners at an alternative location, if not already 17 provided, subject to verification of the authenticity/genuinty of the documents to be produced by petitioners.
No costs.
