The present complaint was disposed of vide order dated 16.11.2018 allowing the complainant to visit his flat on any convenient day and time for inspection alongwith representative of respondent failing which penal action shall be initiated against the respondent-builder. Further the complainant was granted liberty to approach the authority for the final resolution. The complainant on 15.12.2022 filed an application for restoration of complaint stating that the respondent deprived the complainant of the possession of apartment from 03.09.2017. Further the complainant vide letter dated 11.03.2019 requested the respondent to comply with the orders of the authority but respondent vide email dated 27.03.2019 revived the financial demand. The counsel for the applicant seeks liberty to withdraw the application and file a fresh complaint. Request is allowed. Application stands disposed off. File be consigned to the registry.
