MS ARWINDER KAUR AND MS SURINDER KAUR vs VATIKA LTD.

The counsel for the respondent states at bar that the respondent company has already applied for deregistration of the above project alongwith a payment plan for refund to the allottees and refund may be considered in terms of the same plan. The counsel for the complainant stats that inspite of having paid Rs.   31,63,515-00 (including TDS) way back since 2013, there is no progress of construction at site and project is abandoned  as confirmed in the reply of the respondent company and hence is seeking refund alongwith prescribed rate of interest and further shall be filing for litigation cost and compensation, if any,  before the Adjudicating officer. Refund is allowed alongwith  prescribed rate of interest @ 10.60% per annum . Detailed orders will follow. File be consigned to the registry.

In order to constitute new Bench and to revise roaster of cases, the matter is adjourned to 13.01.2023 for further proceedings.
