The  counsel for the complainant has moved an application dated 01.08.2023 for withdrawal of the complaint on the ground that the complainant has received the final payment from the respondent and there is no further  dispute pending between the parties. In view of above,  the matter stands disposed off. File be consigned to the registry.

The counsel for the respondent has placed on record settlement deed dated 16.03.2023 vide which final payment to the complainant shall be made on 18.06.2023.    The counsel for the complainant states that the matter may be listed on any date after the final date for payment so that the settlement could be closed. Matter to come up on 08.08.2023 for further proceedings.

The present complaint was filed on 11.05.2022 and registered as complaint No. 2183 of 2022. As per the registry, complainant has sent copy of complaint along with annexures through speed post as well as through email and proof regarding having the delivery of the complaint along with annexures made to the respondent has been submitted by the complainant as available in the file.  The registry of the authority sent a notice with a copy of the complaint along with annexures through speed post. Registry has also sent the notice along with a copy of the complaint through email at following email address: [email protected] & [email protected] and the same are shown to have been delivered on the above email address as per the report available in the file.  It is not proper service of the notice. On last date of hearing i.e. 02.09.2022, the respondent was directed to file reply within 15 days with an advance copy to the complainant. The counsel for the respondent has supplied a copy of reply to the counsel for the complainant. The respondent is directed to file reply within two weeks i.e. by 16.12.2022 in the registry of the authority. Last opportunity is being granted. In case reply is not filed within the time allowed, the defense of the respondent may struck off. The matter to come up on 02.05.2023  for further proceedings.
