AVANINDRA BATRA vs PAREENA INFRASTRUCTURES PVT. LTD.

The aforesaid complaint was disposed off vide proceedings dated 09.02.2023. While preparing the final order it was observed that there were certain complications and details of the same were not covered vide proceedings of the day. The complainant vide written submission dated 03.03.2023 submitted that the respondent is condoning the cancellation done and demanding further installments from him post filing of this complaint as evident from the email dated 10.03.2021. The counsel for the respondent has filed an affidavit on behalf of the respondent clarifying that the copy of mail seeking demand of the amount post cancellation was never issued  in respect of the unit of the complainant and was inadvertently sent which otherwise was meant for Aviral  Batra allottee of unit No.T2-203. A copy of affidavit has been supplied to the counsel of the complainant who may file response to the above affidavit within a period of 2 weeks. The counsel for the complainant states that the temp. ID of the above complaint seeking refund was generated on 22.02.2021 and the complaint was filed in the registry after serving copy to the respondent on 04.03.2021.  But the intention of the complainant allottee seeking refund was made amply clear while generating the above complaint and proforma-B, a copy of which was also communicated to the respondent.    The counsel for the respondent states that a complaint has been filed by the complainant in NCLT  for the same relief but the counsel for the complainant states that the complaint has been filed by the RWA and not by the complainant. The counsel for the complainant is directed to file an affidavit in this regard within 15 days with an advance copy to the respondent.  Arguments heard. Order reserved.

File taken up today as 9.11.2022 was declared as public holiday by the Haryana Govt. vide notification No.28012006-1HRI dated 3rd November2022 in all offices of the Haryana Govt. in the jurisdiction of the areas namely Ambala Charkhi Dadri Gurugram Karnal Kurukshetra Rewari Rohtak Sirsa and Sonepat in connection with poll for Members of Zila Parishads and Panchayat Samities. In view of above facts the matter is adjourned to 9.2.2023 for the purpose already fixed.
