AJAY WAHI vs SILVERGLADES INFRASTRUCTURE PVT LTD

File put up today on an application filed by DH, with a prayer for rectification of order of this forum dated 13.03.2023. By said order, execution petition filed by applicant/DH was disposed of.                            It is submitted by learned counsel for applicant/DH that he requested to withdraw the execution petition stating that his client (DH) wants to withdraw petition, as same has challenged decree under execution, by filing an appeal before The Haryana Real Estate Appellate Tribunal, while in said order, it is mentioned that parties have settled the matter.                            On 13.03.2023, learned counsel for DH gave a statement mentioning that his client wanted to withdraw the execution petition, on the ground that  same had filed an appeal before the Appellate Tribunal.                              Considering all this, order of this forum dated 13.03.2023 is modified to the extent that execution petition is dismissed as withdrawn, as DH has filed appeal against decree under execution. With this observation, application is allowed.                     File be sent back to the records.
