This is a petition seeking execution of order passed by the Authority, in favour of DH/complainant. The authority through an order/resolution dated on 16.03.2022 delegated its powers to this forum to execute its orders. As per judgment of Hon’ble High Court of Punjab & Haryana, Chandigarh, in case tilted as M/s International Land Developers Pvt. Ltd. Vs. Aditi Chauhan and others CWP No. 7738 of 2022, and M/s International Land Developers Pvt. Ltd. Vs. Nitin Mathur and others CWP 7750 of 2022 for recovery of amount, in execution recovery certificate is required to be issued to the collector concerned. let file be sent back to the authority with a request to issue recovery certificate/further orders.                           Be put up before CA of the Authority on 15.03.2023.

On previous date, show cause notices were issued to directors of JD as why they be not committed to civil imprisonment for not complying with orders of this forum. Needless to say, that vide order dated 29.08.2022, JD was directed to disclose its assets/properties including details of bank account(s). Information was to be given in the form of an affidavit to be sworn by any one from directors, till next date which was 06.10.2022.  No such affidavit was filed till that date. Even then, learned counsel filed an affidavit today in the name of Mr Arvind Walia stated to be director of JD, alongwith copy of some documents stated to be sale deed in favour of JD. After going through said document, it is found that, said property favour of M/s Ramaprastha Greens Pvt. Ltd and not in favour of present of JD.                       Admittedly, direction of this forum are not complied with. Issue arrest warrants against directors of JD namely Sh. Arvind Singh Walia, Sh. Amit Singh for next date, as requested by DH.                      Commissioner of Police, Gurugram is authorized to get them arrested. Same be produced before this forum on or before next date.                    To come on 08.02.2023 for further proceedings.

Information was  to be filed in the form of an affidavit to be sworn by any one from directors preferably by the managing directors. No such affidavit  has been filed despite service.                         Issue show cause notice to said directors of JD as why they be not committed to civil imprisonment for not complying with orders of this  forum. Reply,  if any, be filed till next date.              To come on 30.11.2022 for further proceedings.

It is submitted by learned counsel for DH that appeal  filed by the JD has already been dismissed by the Appellate Tribunal and no decretal amount has been paid till now.                          JD is directed to file an affidavit disclosing its assets/properties including details of bank account(s). Same is to be filed in the form of an affidavit to be sworn by any one from directors preferably by the managing director. Copies of title deeds and statement of bank account(s) also be furnished alongwith affidavit.                       To come on  06.10.2022 for further proceedings.
