Recovery certificate was ordered to be issued in this case to the Collector, Gurugram on 15.12.2022 to recover decretal amount from JD as arrears of land revenue. As per learned counsel for DH, no amount has been recovered till now. On the other hand, according to learned counsel for JD, her client has filed an appeal against order under execution before the Appellate Tribunal and deposited decretal amount in compliance of provision of section 43 (5) of the Act, 2016. The next date before the Appellate Tribunal is 13.01.2025. Copy of an order passed by the Appellate Tribunal dated 26.09.2024 is put on file.                         To come on 21.05.2025 for further proceedings.

This is a petition seeking execution of order passed by the Authority, in favour of DH/complainant. The authority through an order/resolution dated on 16.03.2022 delegated its powers to this forum to execute its orders. As per judgment of Hon’ble High Court of Punjab & Haryana, Chandigarh, in case tilted as M/s International Land Developers Pvt. Ltd. Vs. Aditi Chauhan and others CWP No. 7738 of 2022, and M/s International Land Developers Pvt. Ltd. Vs. Nitin Mathur and others CWP 7750 of 2022 for recovery of amount, recovery certificate is required to be issued to the collector concerned. let file be sent back to the authority with a request to issue  recovery certificate/further orders.                 Be put up before the Authority on 22.12.2022.

It is submitted by earned counsel for JD  that an appeal has been filed before the Appellate Tribunal and next date before there is 07.11.2022.                 To come on 15.12.2022 for further proceedings.

Learned counsel for JD submits that an appeal against order under execution has been filed before the Hon’ble Tribunal and  requisite decretal amount has also been deposited. Next date of hearing is fixed on 07.09.2022.                  In view of statement made by the learned counsel for JD at Bar, matter is adjourned to 13.09.2022.                 To come on 13.09.2022 for further proceedings.
