Vide order dated 13.02.2020 of the authority, the present complaint was adjourned sine die in view of the directions passed by the NCLT on 20.08.2019. The present application filed by the counsel for the IRP for dismissal of the present complaint in view of the settlement by way of an affidavit cum undertaking dated 27.12.2019 wherein the complainant has already taken possession of the apartment along with one basement car parking in the project vide possession letter dated 27.12.2019. Also, the conveyance deed dated 28.01.2020 was executed by the respondent in favour of the complainant. On 21.05.2024, the Authority directed to issue a notice to the complainant /allottee for put in appearance and filing response of the application for dismissal of complaint, failing which the Authority presumed that the complainant/allottee has no objection of the said application and the application shall be further proceeded as per provisions of law. Case has been called out, but no one has appeared on behalf of the complainant today. The case is revived and heard. The counsel for the respondent (IRP) states that the matter has been amicably settled and possession also handed over to the complainant allottee as well as conveyance deed is also executed. The authority has directed the case sine die in view of the orders passed by NCLT. In view of the above, as the matter has already been settled in terms of affidavit cum undertaking dated 27.12.2019, the complaint is disposed off in terms of affidavit cum undertaking dated 27.12.2019.
