HARERA vs VIPUL INFRASTRUCTURE DEVELOPERS

Sh. Ravinder Singh (AR) appeared on behalf of the respondent. AR of the company states that M/s Vipul Ltd had executed joint venture with M/s Orchid Infrastructure and Developers Pvt Ltd and undertake to jointly develop the project. But due to certain reasons, both the companies split their projects which were though being  jointly developed by them. Copy of MOU dated 30-09-2005, general power of attorney dated 19-03-2007 and 21-03-2007 and two public notices dated 04-12-2007 and 05-12-2007 has been filed which is related to settlement of project. At annexure 1 of the MOU, it contains the name of the project without any mention of license number. Hence, authority is of the view that M/s Vipul Ltd shall clarify the licenses of all the projects mentioned at annexure 1 of MOU. Also, a copy of settlement deed and high court order shall be filed before next date of hearing. It is further brought to the notice of the authority that the project mentioned at aforementioned annexure of MOU are transferred from M/s Vipul Ltd to M/s Orchid Infrastructure and Developers Pvt Ltd. Hence, a notice be sent to M/s Orchid Infrastructure and Developers Pvt Ltd for not getting the project registered in the authority and M/s Orchid Infrastructure and Developers Pvt Ltd shall provide the status of the project taken over from M/s Vipul Ltd. Matter to come up on 06-03-2024 at 10:00 A.M.

Sh. Rajesh Gopal Krishan and Sh. Ashutosh appeared on behalf of the respondent. AR of the company appears and filed the reply today itself. However, the main authorized representative of the company is out of station and hence he requests a short adjournment to argue the matter on next date of hearing. Matter to come up on 08-02-2024 at 10:00 A.M.

None appeared on behalf of the respondent. On account of absence of promoter or their authorized representative, authority is in the view that you have nothing to say about the case. Therefore, one final opportunity of hearing is given to submit the detailed reply and appear before the authority for hearing on 05-10-2023 at 11:00 A.M. otherwise authority shall be bound to proceed Ex-parte.

With reference to show cause notice No. RERA-GRG-6298-2019 dated 10.12.2019, none on behalf of company appeared before the authority for personal hearing.  The reply submitted by the respondent is still under scrutiny.             The case adjourned to 20.04.2020 at 11:00 AM.

With reference to show cause notice No. RERA-GRG-6298-2019 dated 10.12.2019, Shri Sheetanshu Shekhar, legal executive on behalf of company appeared before the authority for personal hearing.  The reply submitted by the respondent is under scrutiny.             The matter is fixed for hearing on 25.02.2020 at 11:00 AM.
