HARERA vs PURI CONSTRUCTION PVT LTD

Sh. Himanshu Juneja (Legal Head) and Smriti Rani (Manager-Legal) appeared on behalf of the respondent. The promoter has submitted that they had applied for TOD permission and later on applied for migration of license. The promoter is directed to file the proof of applying for migration of license within two weeks. Final opportunity is given to the promoter to submit the details of the project. On 15-02-2024, the promoter has submitted the notarised affidavit on behalf of the director regarding license no. 98 of 2010 whereas the present Suo motu complaint relates to license no. 99 of 2010 which shows there is a clerical error in the affidavit submitted by the promoter. Therefore, the AR of the promoter is directed to file a revised affidavit within two weeks. Matter to come up on 13-03-2024 at 10:00 A.M.

Sh. Mandeep Singh Oberoi (Director), Sh. Himanshu Juneja (Legal Head) and Smriti Rani (Manager-Legal) appeared on behalf of the respondent. Director of the company present in person has submitted an affidavit during the course of hearing which needs to be examined. Also, the director is further directed to explain the reasons in writing regarding pasting and scanning of his signature on the affidavit submitted by him earlier on 16-01-2024 and why penal action should not be taken against the promoter for submitting such wrong affidavit (with scanned signature) to the authority. Matter to come up on 29-02-2024 at 10:00 A.M.

On the last date of hearing, the promoter is directed to file the affidavit which the AR states that they have already filed, however, the same is not readily available. A copy of the affidavit along with the acknowledgement dated 16-01-2024 regarding filing of the affidavit is being filed today itself and a site visit report of the concerned licensed land is awaited. Authority to examine the same and to come up for further proceedings on 07-02-2024 at 10:00 A.M.

Sh. Himanshu Juneja (Legal Head) appeared on behalf of the respondent. The AR of the promoter states that no building plan of the project has been sanctioned/approved by the company and project has not been yet launched and no third party right has been created. He further states that the promoter has applied under migration policy to get the project migrated from commercial to group housing colony. Also, the company is in the process of availing benefits of TOD scheme. The promoter is hereby directed to file an affidavit duly notarized and signed by the director of the company along with board resolution to this effect within a period of one week. Also, the project site shall be inspected by the planning executive of the authority and Ms. Jyoti (PE) is hereby directed to visit the project site and report the actual status of the project. Matter to come up on 24-01-2024 at 10:00 A.M.

None appeared on behalf of the respondent. On account of absence of promoter or their authorized representative, authority is in the view that you have nothing to say about the case. Therefore, one final opportunity of hearing is given to submit the detailed reply and appear before the authority for hearing on 05-10-2023 at 11:00 A.M. otherwise authority shall be bound to proceed Ex-parte.

With reference to show cause notice No. RERA-GRG-6499-2019 dated 12.12.2019, none on behalf of company appeared before the authority for personal hearing. The reply submitted by the respondent is under scrutiny and further the respondent is directed to submit copy of valid license within 7 days             The matter is adjourned to 20.04.2020 at 11:00 AM.

With reference to show cause notice No. RERA-GRG-6499-2019 dated 12.12.2019, Shri Himanshu Juneja, on behalf of company appeared before the authority for personal hearing. The reply submitted by the respondent is under scrutiny.             The matter is fixed for hearing on 25.02.2020 at 11:00 AM.
