HARERA vs RAHEJA DEVELOPERS LTD

Counsel for promoter states that OC of above said project was obtained prior to RERA, 2016 coming into force. Detailed reply is being filed today and Authority to examine the same. The matter adjourned to 24.07.2024 at 11:30 A.M.

On last date of hearing promoters were directed to explain the total area of license and the area, Occupation Certificate of which has been received prior to RERA coming into force. The AR seeks time to submit reply of the same. The matter adjourned to 10.07.2024 at 11 A.M.

Sh. Sanjay Sachdeva (Vice President) appeared on behalf of the promoter and states that  as per approved building plan, total number of units is 525 whereas occupation certificate is obtained for 512 units. Hence, they are directed to apply for registration of remaining units within a period of one month. Also, the promoter shall clarify the total land area which is yet to be registered in the authority. Matter to come up on 27-06-2024 at 10:30 A.M.

Sh. Sanjay Sachdeva (Vice President) appeared on behalf of the promoter and requested for adjournment of hearing to submit the reply in compliance of directions given by the authority vide proceeding dated 10-04-2024. Reply filed by the promoter during last hearing has been examined and it has been found that OC obtained on 26-05-2008 for Block A, B1, D1 and D2, OC obtained on 08-03-2010 for tower A and B, OC obtained on 19-01-2011 for Type C, Type E, Convenient shopping, community hall whereas OC for Type F, Type A, Block C & D, Block B has not been filed in the authority. Sh. Prince Kumar (Manager) appeared on behalf of the promoter and states that OC has been obtained for the said license. The promoter is directed to submit the approved building plan of the project along with built up drawings submitted at the time of obtaining OC to verify whether OC received by them pertains to the whole project or not. None appeared on behalf of the promoter. The promoter is hereby given final opportunity of hearing and show cause as to why penalty under section 63 of RERA Act 2016 should not be imposed upon you for failure to comply with the directions of the authority. Sh. Prince Kumar (Manager) is appeared on behalf of the promoter. The AR of the promoter has filed the copy of board resolution. On account of absence of promoter or their authorized representative, authority is of the view that final opportunity of hearing is given to the promoter to appear before the authority on 14-09-2023 at 11:00 A.M. The promoter is directed to appear physically before the authority on next date of hearing otherwise penal proceedings will be initiated as per provisions of RERA Act 2016.

None appeared on behalf of the promoter. On account of absence of promoter or their authorized representative, authority is in the view that you have nothing to say about the case. Hence, a final opportunity is given for filing of application for registration of your project under section 4 of the RERA Act, 2016 within three weeks failing which penalty under section 59 shall be imposed which can be upto 10% of project cost. Last final opportunity to appear on 24-08-2023 at 11:30 A.M. otherwise matter shall be decided on merits.
