Learned counsel for JD requests for adjournment stating that his client has filed in appeal, but same is still to be listed before the Appellate Tribunal. Learned counsel for DH objected the adjournment stating that JD had sought adjournment  on previous date also, on same ground.                            Admittedly, there is no stay against the proceedings. Appeal (if any) is still to be listed. No reason for adjournment. Request in this regard is declined.                          This is matter for recovery. Recovery certificate is required to be issued. The matter is referred to account officer for 05.07.2023 to calculate the amount due. Certain objections are filed by JD in the forum of application. It is submitted by learned counsel for JD that her client has filed an appeal, i.e appeal no. 187/2023.                       Learned counsel for DH requests for direction to JD to hand over the possession of subject unit to his client. Counsel for JD objected the same stating that this was not part of decree.                       When this was not part of decree, being an executing court, this forum cannot stress on handing over of the possession. Request of DH in this regard is thus declined.                        To come on 25.05.2023 for further proceedings.
