No objections are filed on behalf of JD.                            This is a petition seeking execution of order passed by the Authority, in favour of DH/complainant. The authority through an order/resolution dated on 16.03.2022 delegated its powers to this forum to execute its orders. As per judgment of Hon’ble High Court of Punjab & Haryana, Chandigarh, in case tilted as M/s International Land Developers Pvt. Ltd. Vs. Aditi Chauhan and others CWP No. 7738 of 2022, and M/s International Land Developers Pvt. Ltd. Vs. Nitin Mathur and others CWP 7750 of 2022 for recovery of amount, recovery certificate is required to be issued to the collector concerned. let file be sent back to the authority with a request to issue recovery certificate/further orders.                         File be sent to CA on 06.04.2023 for preparing recovery certificate.

Show cause notices were ordered to be issued to the directors of JD, as why same be not committed to civil imprisonment for not complying with order of this forum.                             Learned counsel for JD, requests for six months’ time to make  payment by selling some properties owned by sisters concern of JD.                            During deliberations, it is agreed that matter be adjourned after three months to see as what efforts are being made by JD to procure the amount by selling property (if any).                           To come on 06.03.2023 for further proceedings.

On previous date i.e. 09.05.2022, JD was directed  to give particulars of its asset/properties including details of bank account(s). Same were to be furnished in the form of an affidavit to be sworn by any one from directors preferably by managing director. No such affidavit is  filed despite service  upon S/Shri Arvind Walia, Balwant Chaudhry Singh, Sandeep Yadav, stated to be directors of JD. Learned counsel for DH requests to issue arrest warrants against said directors of JD.                       Issue show cause notice  to directors of JD as why they be not committed to civil imprisonment for not complying with orders of this forum. Reply, if any, be filed till next date.                       To come on 06.12.2022 for further proceedings.

Adjudicating Officer on leave, adjourned to 28.09.2022.

Vide order dated 24.03.2022 of the Authority, directors of JD were  ordered  to be called in person for oral examination, with regard to assets/properties of JD. No report about service of notice.                   JD be directed again to give particulars of its assets/properties  including details of bank account(s) other than escrow account. Same be filed in the form of affidavit to be sworn by any from directors preferably by the managing director. Copies of title deeds as well as statement of bank account(s) be also furnished alongwith affidavit.                    To come on 27.07.2022 for further proceedings.

The counsel for the JD, on the instructions of AR, has stated at bar that they have already filed  CWP  bearing No. 13841 of 2021 in the Hon’ble High Court in the above captioned matter  and vide order dated 28.07.2021 the Hon’ble High Court has issued a notice for 02.09.2021 and has also passed an interim directions in the same terms as were passed in CWP No.13639 of 2021 i.e.  execution proceedings would be held in abeyance till the next date of hearing  i.e. 2.9.2021. Copies of both the orders are also placed on record.                 In view of above facts, the Authority is of the considered view that the matter be adjourned sine die awaiting  outcome of appeal. File be consigned to the registry.

Matter to come up on 29.07.2021 for further proceedings.

Vide resolution No.6889 dated 9.4.2021  District Bar Association Gurugram has conveyed that on the occasion of festival “Besakhi & Ambedkar Jyanti”,  13.4.2021 and 14.4.2021   has been declared as local holiday in District Court Gurugram and requested to adjourn the cases as per convenience of the Authority.              Matter to come up on 13.05.2021.
