Today was for consideration on application filed by LRs of deceased Neerja Singh. Not opposed. Considering all this, request is allowed.                         Recovery certificate was issued in this case to the Collector, Gurugram, on 16.01.2024 to recover decretal amount from JD as arrears of land revenue. As per learned counsel for DH, no amount has been recovered through Collector, till now. He requests for direction to JD to disclose its assets/properties including bank account and unsold inventories which can be attached to realize decretal amount. Request is allowed. Information to be given in the form of affidavit to be sworn by anyone from directors of JD, preferably by Managing Director. At the same time, Recovery Officer (Tehsildar) of Authority, Sh. Recovery certificate was issued to the Collector, Gurugram in this matter on 16.01.2024 to recover decretal amount as arrears of land revenue. In view of order/circular issued by Chief Secretary Government of Haryana, no. 50/15/20240-5S (1) dated 11th May 2024, powers of the Collector have been conferred upon the Adjudicating Officer and all the recovery certificates have been received back.                          As per learned counsel for DH, no amount has been recovered through Collector, Gurugram till now. He requests to resume executing proceedings.                    In view of the facts as mentioned above, request of learned counsel for DH is allowed and the execution proceedings are resumed.               An application is filed under order 22 Rule 2 read with section 151 CPC. As per learned counsel for applicant, DH Neerja Singh has expired leaving behind two sons as LRs apart from husband. Certain objections are filed on behalf of JD. Copy given. At the same time, learned counsel for JD requests for adjournment for about two weeks stating that main counsel could not come today, having suffering fracture in her leg. Reminding that this forum being executing court is bound to dispose of the execution petition at the earliest Learned counsel referred a case decided by Apex Court of India titled as Rahul Saha Vs.
