    The counsel for the JD has submitted  an application alongwith a copy of order passed in SLP bearing No. 1904/2021 registered on 29.1.2021 filed by Supertech Limited against Union of India before Hon’ble Supreme court  and the same has been tagged with SLP © No.13005 of 2020.  The relevant of order dated 12.2.2021 is reproduced as under”-                “In the meantime, there shall be stay of the operation of the impugned judgment and order passed by the Hon’ble  High Court and the execution cases filed pursuant to the orders of   the Regulatory Authorities  and appellate authorities.            However,  we clarify that the Appellate Authority under the Real Estate (Regulation and Development) Act 2016  would be entitled to take up the appeal, if any, pending for hearing and decision on merits, in case there is no objection from the respondent.  This clarification will not apply to those cases where the appeal itself has been dismissed.               Tag with SLP © No.13005 of 2020 etc.”                                    In compliance of previous orders dated 13.10.2020 Bank Manager Union of India, E9, Dilshad Colony, Dilshad Garden, New Delhi  was directed to attach the bank account of the JD to remit the decretal amount of  Rs.1,09,03,259/- to be paid to the Authority.  In pursuance of the said order the Union Bank of India, vide its letter dated 16.11.2020 intimated that they have no bank account of the JD as the said account was closed on 17.2.2018.                            Accodingly, the account of the JD attached earlier vide order dated 13.10.2020 be de-freeze in further of direction  passed by the Apex Court (supra).  Registry is directed to do the needful.              Keeping in view the above mentioned facts, the Authority is of the considered view that the matter be adjourned sine die awaiting  outcome of SLP. File be consigned to the registry.
