Application under Section 36 of RERA Act filed by the complainant has already been decided by the Authority on 08.01.2025. Now the matter is listed before the Authority on 05.03.2025 which is already fixed for further proceedings.

The present complaint was filed on 21.10.2024 and reply on behalf of the respondent had not been filed till date.  Meanwhile, the counsel for the complainants has filed an application dated 21.10.2024 under Section 36 of the Act stating that the complainant booked a unit bearing no. 403, 4th floor, Tower D having approximate super area of 1874 sq. ft., along with two mandatory covered car parking space, in a group housing project “Capital Gateway” bearing license no. 34 of 2011 situated at Sector-111, revenue Estate of village Chauma, Gurugram seeking possession of the unit along with delay possession charges. Further, the complainants apprehend that the respondent may attempt to siphon off or dissipate the funds or will try to create a third-party interest in the subject property thereby depriving the complainants of their rightful claims.  Therefore, the complainant is seeking that respondent be directed to restrain from creating any third-party rights in the property in question and further direct the respondent to jointly and severely deposit the interest amount of Rs.30,61,966.08/- in terms of Section 15 of the RERA Act with the registrar of the Authority, pending the final decision of the present complaint.  Shri Mani Bhushan Sinha Advocate has appeared on behalf of the respondent and filed power of attorney today during proceedings and seeks a short adjournment to file a reply to the application dated 21.10.2024 under section 36 of the Act, 2016. He further states that third party rights have already been created on the unit of the complainant.  Matter to come up on 05.03.2025 for further proceedings.
