The counsel for the complainant has filed an application under Section 36 of the Act, 2016 seeking early hearing in the matter stating that the complainant has booked a plot measuring 300 sq. yds. in the project of the respondents named Ramprastha City at Sector 37 C & D/92, 93 and 95 Gurugram by paying a sum of Rs.22,50,000/- towards full consideration of the plot back in 2011 and the same was duly acknowledged by the respondent vide receipt dated 12.07.2011. However, the respondents have failed to comply with the provisions of the Act, 2016 and have not even allotted a specific plot number to the complainant. He further submits that the complainant vide several communications has requested the respondents to handover possession of a specific plot after allotment and execute a builder buyer agreement with him, but the respondents have in complete defiance of their obligations refused to do the same and he is under a strong apprehension that respondents will allot/resale/create third party rights/dispose the land comprised in the project/create charges and mortgages thereon through various arrangements, devices and stratagems to/in favour of third parties, so that no land is left for allotment of plots and thereby deprive allottees such as complainant of his just and due rights, entitlement and equities. Hence, the present application. None is present on behalf of the respondent today. The respondent is directed to disclose as to what futuristic project is being referred to in the receipt dated 16.03.2011 within a period of 2 weeks from today. Matter to come up on 05.02.2025 for further proceedings.
