The present complaint was filed on 29.09.2023 and a reply on behalf of respondent no. 2 was received by the Authority on 04.09.2024, even though the defense of the respondents was struck off by the Authority during its hearing dated 29.05.2024. Further, an application dated 19.11.2024 had been filed by the counsel for respondent no. 1 under Order IX Rule 13 of CPC, 1908 for setting aside the ex-parte order dated 29.05.2024. The counsel for the complainant vehemently objects to the request of counsel for R1.        The authority considers it expedient to allow the counsel for R1 to file the application as requested within a period of 2 weeks in the interest of justice. The same may be filed within the time provided with an advance  copy to the counsel for the complainant. Matter to come up on 18.12.2024   for further proceedings.

As per postal tracking report ED487571747IN (respondent no.1) and ED487571628IN (respondent no. 2) copy of complaint was sent to the respondents on 23.09.2023 and premises of respondent no. 1 was found locked and item was on hold on the door locked of respondent no. 1 and that post was duly delivered to respondent no. 2 on 25.09.2023. Registry of the authority also sent notice along with copy of complaint on 03.10.2023 to both the respondents on their following email address: [email protected] and [email protected] Despite several calls none appeared on behalf of the respondent. Now the case is adjourned for 02.02.2024 for appearance of respondent and for filing reply on behalf of respondent subject to last opportunity.
