As per the previous order dated 29.11.2023 the respondent was directed to file reply within a period of two weeks in the registry with an advance copy to the complainant subject to last opportunity failing which defence of respondent shall be struck off. Admittedly the respondent has not filed reply within the stipulated period given in the last order dated 29.11.2023. Sh. Rahul Raghav Advocate for respondent requested for adjournment, which is highly opposed on behalf of ld. Counsel for complainant. Heard in the interest of justice case is adjourned for 08.02.2024 for filing reply on behalf of respondent subject to cost of Rs. 5000/- and last opportunity failing which matter shall be listed before the authority for final arguments.

The present complaint was filed on 31.8.2023 and registered as complaint No. 3912/2023. The counsel for the complainant states that they have already  paid 100%  of the amount even two years back and now  paying EMI and rent  from their own pocket and the respondent is not giving possession of the unit.  Respondent is hereby directed  to apprise the Authority the status of the project and the schedule of its completion and tentative date of handing over of the units to the allottees on or before the next date of hearing and further directed to upload this status on the website of the respondent itself. However, no reply has been received on behalf of the respondent to date. The counsel for the respondent appearing on behalf of the respondent has filed power of attorney and  requests for a short adjournment for filing of the reply within two weeks.  The respondent is directed to file a reply within two weeks in the registry with an advance copy to the complainant failing which the defence of the respondent shall be struck off.  It is the last opportunity is being granted to the respondent. Matter to come up on 24.01.2024  for further proceedings.
