The complainant is seeking the relief of physical possession as well as delay possession charges. None appeared on behalf of the respondent today. The Authority observes that the request of the complainant cannot be considered at this stage as the registration certificate granted by the Authority has already been revoked on 11.03.2024 and even license of the respondent promoter has been expired. Hence in view of the above, the matter is adjourned sine die with liberty to the complainant to revive the complaint at the appropriate time. File be consigned to the registry.

The present complaint was filed on 19.04.2023.Despite proper service of notice, no written reply has yet been filed. Moreover, the service is also confirmed from the fact that on the last date of hearing, Shri Rahul Raghav Advocate, of the respondent company appeared and was directed to file the reply within two weeks, i.e., by 14.12.2023, in the registry with a copy to the complainant subject to payment of Rs.5000/- as cost to be paid to the complainant failing which the defence of the respondent shall be struck off.    Written reply has not been filed by the respondent so far.  Meanwhile in suo-moto proceedings before the Authority, the registration certificate issued to the respondent-promoter has been revoked by the Authority vide proceedings dated 11.03.2024.  Further action for completion of the project is being taken by the Authority under section 8 of the Act, 2016 in consultation with the Government. In view of the above, the matter to come up on 03.09.2023 before the full bench for further proceedings when similar matters are listed on that date.

Neither reply filed nor previous cost of Rs. 5000/- paid. Now the matter is listed before the authority on 04.04.2024 for further proceedings.
