The present complaint was filed on 18.07.2022 and reply on behalf of the respondents has not been filed till date. The defense of the respondents has been struck of vide order dated 07.02.2024 and cost of Rs. 5,000/- imposed on respondents vide order dated 08.11.2023 has also not been paid. Vide last order dated 01.05.2024, the Authority decided to proceed ex-parte against the respondents. The proxy counsel for the complainant seeks a short adjournment as the arguing counsel is not available today.    The proxy counsel for the respondent for R1 states that CIRP has been initiated against the respondent-company and places on record an order dated 27.04.2022 passed by the Hon’ble Supreme Court in CA No.7534 of 2021 titled as Anand Murti vs. Soni Infratech Pvt. Ltd. and another and further states that  litigation is pending in the matter. Matter to come up on 16.04.2025 for further proceedings. Meanwhile, the  complainant is directed to clarify the relief being sought in the matter as  both refund as well as DPC have been mentioned in the relief sought in the complaint.

Since the Hon’ble Member is on leave,  hence, the matter is adjourned to 05.02.2025 for the purpose as already fixed.

As per the previous order dated 08.11.2023 respondent was directed to file reply along with cost of R s. 10000/- within 15 days, failing which defence of respondent shall be struck off. Despite the stipulated period, the respondent did not filed reply and also not paid cost of Rs. 10000/-. In continuation of order dated 08.11.2023 defence of respondent struck off. Now the case is listed before the authority on 01.05.2024 for final arguments.

The respondent is  directed to file a reply within two weeks i.e., by 30.08.2023 in the registry with a copy to the complainants subject to costs of Rs.10,000/-, for not complying with the orders of the authority.
