SACHIN CHAUHAN vs SAI AAINA FARMS PVT. LTD

The present complaint was filed on 10.01.2024 and registered as complaint no. 53 of 2024. Despite proper service of notice, no written reply has yet been filed. The complainant is seeking the relief of physical possession as well as delay possession charges. None appeared on behalf of the respondent today. The Authority observes that the request of the complainant cannot be considered at this stage as the registration certificate granted by the Authority has already been revoked on 11.03.2024 and even license of the respondent promoter has been expired. Hence in view of the above, the matter is adjourned sine die with liberty to the complainant to revive the complaint at the appropriate time. File be consigned to the registry.

As per the previous order dated 20.03.2024, respondent was allowed to file reply within three weeks of the order with total cost of Rs. 5,000/- failing which defence of respondent may be struck off. Neither reply filed by the respondent within stipulated period nor cost of Rs. 5,000/- paid. As respondent is not filing reply and also not paying cost, to the reasons best known to the respondent, so now the matter is listed before the Authority on 21.08.2024 for final arguments.

Neither reply filed within the stipulated period given in the order dated 13.12.2023 nor previous cost of Rs. 5000/- paid on behalf of the respondent. Adjournment requested. In the interest of justice, the case is adjourned for 15.05.2024. Respondent is directed to file reply, if any, within three weeks of this order with additional cost of Rs. 5000/- (total 10000/-) failing which defence of respondent may be struck off.
