GIRISH AHUJA vs VATIKA LIMITED

The present complaint has been filed on 01.08.2022 and reply was received on 12.04.2023. On 19.07.2023, the counsel for the respondent stated that the co-allottee Ms. Vinita Ahuja is not represented in the complaint and the complaint is liable to be dismissed for non-joinder of party, where the counsel for the complainant seeks adjournment to file power of attorney on part of co-allottee within 2 weeks. Further on 02.11.2023, the counsel for respondent seeks four week’s time to file the legal heir’s certificate and amended memo of parties and request for adjournment. On 30.11.2023, the counsel for the complainant filed the power of attorney dated 29.11.2023, executed by Ms. Vinita Ahuja (Executant) in favour of her husband Mr. Girish Ahuja.       The counsel for the complainant has filed power of attorney by Mr. Vinita Ahuja authorizing Mr. Garish Ahuja to file the complainant before RERA on her behalf and to sign all the requisite documents  but the name of co-allottee Ms. Vinita Ahuja is not in the memo of parties. The counsel for the complainant is directed to file memo of parties within 10 days. Matter to come up on 08.08.2024 for further proceedings.

The present complaint has been filed on 01.08.2022 and reply was received on 12.04.2023.  Case has been called out but no one has appeared on behalf of the complainant.  One last and final opportunity is being granted to the complainant to appear and to pursue the matter.
