MAHESH SAINI vs SAI AAINA FARMS PVT. LTD

The present complaint was filed on 23.06.2023 and registered as complaint no. 2926 of 2023. Despite proper service of notice, no written reply has yet been filed. Moreover, the service is also confirmed from the fact that on 15.02.2024, Shri Rahul Raghav Advocate, of the respondent company appeared and was directed to file the reply in the registry with a copy to the complainant subject to payment of Rs.10,000/- as cost to be paid to the complainant failing which the defense of the respondent shall be struck off. The complainant is seeking the relief of physical possession as well as delay possession charges.None appeared on behalf of the respondent today. The Authority observes that the request of the complainant cannot be considered at this stage as the registration certificate granted by the Authority has already been revoked on 11.03.2024 and even license of the respondent promoter has been expired. Hence in view of the above, the matter is adjourned sine die. File be consigned to the registry.

As per the previous order dated 15.02.2024, the case was adjourned for 29.02.2024 for filing reply on behalf of the respondent subject to cost of Rs. 10,000/- failing which defence of respondent shall be struck off. Till today neither reply filed on behalf of the respondent nor cost of Rs. 10,000/- paid to the reasons best known to the respondent. As respondent is not filing reply despite availing several opportunities and also not paying cost of Rs. 10,000/- so now the case is listed before the Authority on 07.08.2024 for final arguments.
