The present complaint has been filed on 08.12.2022 and the reply was received on 06.12.2023 by the respondent no. 5, 6,7. However, no reply has been filed by the respondent no. 1 to 4, R 8 to R 10, R 11 to R13. Vide proceeding dated 09.01.2024, the counsel for respondent No 1 to 4 and Respondent NO.8 to 13 requests for one final opportunity to file reply within one week which could not be filed due to some complexity and further undertakes for filing reply within one week and if the reply is not filed in one week, then the defense shall be struck off. Till date no reply has been filed by the respondents. The counsel for the respondent Nos. 1 to 4 and 8 to 13  have been given multiple opportunities to file the reply and the respondents sought adjournment on  3 occasions to file the reply but the same has not been filed. Arguments heard. Both the counsels for the parties are directed to file written submissions within a period of 15 days with an advance copy to each other. Matter to come up on 15.10.2024  for final arguments/orders.

Vide proceedings dated 20.04.2023 the respondent was asked to give a explanation for not handing over the possession till now and hence why refund should not be allowed alongwith interest from the date of deposit of amount. The present complaint was filed on 08.12.2022 and registered as complaint no. 7318 of 2022. Despite proper service of notice, no written reply has yet been filed. The counsel for respondent Nos. 5 to 7 has put in appearance today and filed power of attorney and a certified copy of resolution passed by the Board of directors and is requesting for a short adjournment for filing reply.  He is directed to file the reply within three  weeks in the registry with a copy to the complainant along with cost of Rs.5,000/- to be paid to the complainant. The counsel for the respondent Nos. R1 to R4, R8 to R10, R11 to R13 is requesting for a short adjournment for filing of reply.  The respondents are  directed to file the reply within three  weeks in the registry with a copy to the complainant failing which respondent shall file reply alongwith cost of Rs.10,000/- to be paid to the complainant.   Previous cost of Rs.10,000/- has been paid by the respondent to the counsel for the complainant during proceedings. Last opportunity is being granted to all the respondents. In case the reply is not filed within the time allowed, the defence of the respondent shall be struck off and Planning department of the authority is also directed to submit the report as per directions dated 06.07.2023. The counsel for the respondent requests for a short adjournment for filing of reply.  The respondent is directed to file written reply in the registry of the Authority wherein also explaining the reason for not handing over the possession, within two weeks i.e., by 20.07.2023 subject to  cost of Rs. 10,000/- to be paid to the complainant. In case reply is not filed within the time allowed, the defence of the respondent shall be struck off. Despite directions during the last proceedings for filing the status of handing over of possession,  no status has been filed and neither the main counsel or the representative of respondent is present to clarify which show scant regard to the orders of the authority and hence planning branch is directed to check the status of the above project and to initiate penal proceedings against the promoter if either the project is not registered or the period of handing over of possession elapsed.  A reminder to the remaining respondents for put in appearance and filing of reply be issued failing which defence of the respondent shall be struck off. The counsel for the respondent requests for a short adjournment for filing of reply.  The respondent is directed to file reply in the registry of the Authority within three weeks i.e., by 11.05.2023, with an advance copy to the complainant. In case reply is not filed within the time allowed, the defence of the respondent may struck off. If reply is not filed within 15 days, an additional cost of Rs. 5000/- will be imposed.  The counsel for the complainant states that despite having paid total sale consideration, possession is not yet handed over. The respondent to also explain the reasons for not handing over the possession till now and hence why refund should not be allowed alongwith interest from the date of deposit of the amount.        Matter to come up on  6.7.2023   for further proceedings.
