    The present complaint has been received on 17.08.2023 and registered as complaint no. 3602 of 2023 and reply on behalf of respondent was received on 14.12.2023. On last date of hearing, the counsel for the complainant stated that although a conveyance deed has been executed but the possession of the unit is not yet handed over to the complainant and the unit has been further leased to a third party and no lease rentals are being paid and neither the complainant is a confirming party to the lease. The counsel for the complainant requests for physical hand over of possession which is not yet handed over and neither any commitment charges on leasing out of the unit  by the respondent are being paid. Therefore, the complainant requests for physical possession and till same,  the commitment charges be got paid. Since while filing the complaint, relief of physical possession has not been sought and hence, to amend the relief an application be filed by the complainant after supplying a copy of the same to the respondent.   The counsel for the respondent states that  a subsequent proposal through letter dated 04.10.2021  has been agreed between the parties and the charges have been paid in terms of said letter. Matter to come up on 09.01.2025 for further proceedings.
