Since the Hon’ble Chairman/Members of the Authority are busy to attend the 2nd Annual Conference AIFORERA to be held from 16.07.2024 to 19.07.2024 at Kodaikanal (Tamil Nadu) hence,  the matter is adjourned to  09.08.2024 for pronouncement of order.

The matter is adjourned to 19.07.2024 for the purpose as already fixed.

As per the previous order dated 17.11.2023 respondent was directed to file reply within the period of two weeks i.e. 22.01.2023 and in case reply not filed within the time allowed then same shall be filed along with cost of Rs. 5000/-failing which defence of respondent may be struck off. Till today, neither reply filed within the stipulated period nor cost of Rs. 5000/- paid. Perusal of the case file duly reveals that complaint was filed on 06.04.2023 and notice to the respondent was served on 13.04.2023 and since then case is fixed for filing reply on behalf of respondent. As despite availing several opportunities including imposition of cost, respondent has not filed reply so in continuation of order dated 17.11.2023 defence of respondent is hereby struck off. Now the case is listed before the authority on 17.05.2024 for final arguments.

On the previous date of hearing i.e. on 15.9.2023,  last opportunity was granted to file reply within two weeks. Written reply not yet filed by the respondent. Shri Rishabh Gupta, Advocate has appeared on behalf of the respondent and filed power of attorney and states that he is newly engaged  by the respondent and seeks two weeks time to file  the reply.  Request is allowed. The respondent is directed to file reply within a period of two weeks i.e. by 01.12.2023 after supplying a copy to the counsel for the complainant. In case reply is not filed within the allowed time, the same shall be filed alongwith cost of Rs. 5000/- to be paid to the complainant filing which the defence of the respondent may be struck off. Matter to come up on 16.2.2024 for further proceedings.

On the last date of hearing on 1.9.2023, the respondent was directed to file reply within a period of 10 days in the registry of the authority after supplying a copy to the counsel for the complainant. None appeared on behalf of both the parties. The respondent is given one last opportunity to file reply within two weeks after supplying a copy to the counsel for the complainant  failing which the defence shall be struck off and no further opportunity shall be granted.  This shall be the last opportunity. Matter to come up on 17.11.2023 for further proceedings.

Due to administrative reasons, the case is adjourned for the purpose already fixed. Respondent is directed to file reply within a period of 10  days in the registry of the authority after supplying a copy to the counsel for the complainant. Matter to come up  on 15.9.2023 for further proceedings.
