The present complaint has been received on 28.02.2023 and the reply on behalf of respondent has been received on 08.02.2024. Reply filed by the respondent in the registry on 08.02.2024 taken on record. Cost of Rs. 10000/- not paid. Learned counsel for respondent submitted that cost imposed on 25.01.2024 may be waived. Learned counsel for complainant submitted that as respondent not filed reply within stipulated period so cost of Rs. 10000/- was rightly imposed so the same may not be waived. As the respondent itself is at fault for not filing reply within the stipulated period so cost of Rs. 10000/- was imposed. On the grounds alleged on behalf of respondent for waiving of cost are not justified. On the request of learned counsel for respondent now the case is adjourned for 29.02.2024 for payment of cost Rs. 10000/- failing which reply filed by respondent shall not be read over and in that eventuality defence of respondent shall be struck off.

Despite several calls none appeared on behalf of the respondent. Reply also not filed on behalf of respondent within stipulated period. Now the case is adjourned for 15.02.2024 for filing reply on behalf of respondent subject to cost of Rs. 10000/- and subject to last opportunity failing which matter shall be listed before the authority for final arguments.

The present complaint was filed on 28.02.2023 and registered as complaint no. 826 of 2023. The counsel for the respondent states that he has not received the amended/final copy of the complaint which is complaint No.826/2023 whereas the performa was generated as CR No.556 of 2023 in which there is only one respondent appearing.  Due to this confusion, the respondent could not file the reply, hence the complainant is hereby directed to hand over a copy of the complaint No.826 of 2023 to the counsel for the respondent today itself and the counsel for the respondents shall file the reply within next 2 weeks with an advance copy to the complainant. Previous cost not paid by the respondent. Counsel for the respondent is directed to pay the previously imposed cost vide order of the authority dated 10.08.2023.  Last opportunity is being granted.
