PARTH KHUNGAR vs SAI AAINA FARMS PVT. LTD

The present complaint was filed on 02.11.2023 and registered as complaint No. 4957 of 2023. Despite proper service of notice, no written reply has yet been filed. Moreover, the service is also confirmed from the fact that on 10.04.2024, Shri Rahul Raghav Advocate, of the respondent company appeared and was directed to file the reply in the registry with a copy to the complainant subject to payment of Rs.10,000/- as cost to be paid to the complainant failing which the defense of the respondent may be struck off. The complainant is seeking the relief of physical possession as well as delay possession charges. None appeared on behalf of the respondent today. The Authority observes that the request of the complainant cannot be considered at this stage as the registration certificate granted by the Authority has already been revoked on 11.03.2024 and even license of the respondent promoter has expired. Hence in view of the above, the matter is adjourned sine die. The complainant may revive the complaint as and when the project  is revived.  File be consigned to the registry.

Neither reply filed by the respondent (within the stipulated period given in the order dated 10.04.2024) nor cost of Rs. 10,000/- paid. Today despite calls none appeared on behalf of the respondent. As respondent is not filing reply and also not paying cost so now the case is listed before the Authority on 09.10.2024 for final arguments.

Neither reply filed nor previous cost of Rs. 2,000/- paid on behalf of the respondent. Adjournment requested. In the interest of justice, the case is adjourned for 10.07.2024. Respondent is directed to file reply, if any, within three weeks of this order with additional cost of Rs. 8,000/- (total 10,000/-) failing which defence of respondent may be struck off.
