The  present complaint was filed on 19.05.2023 and registered as complaint no. 2323 of 2023 and the reply on behalf of respondent has not been received till date. The counsel for the respondent requests for an adjournment to file reply to the complaint as well as application for dismissal of complaint as the said complaint is filed by 2 different allottees of two different units and hence, is not maintainable. The counsel for the complainant states that during the last proceedings it has been mistakenly written that the reply has been supplied which was not supplied, neither the cost has been paid.  The counsel for the respondent assures to supply copy within next 4 weeks and the cost shall also be paid before the next date of hearing. Matter to come up on 06.03.2025 for further proceedings.

The registry of the authority sent a notice along with the copy of the complaint through speed post and email and delivery of same was confirmed on 12.05.2023 and 16.05.2023 respectively. On 11.01.2024 and 05.10.2023, respectively none was appeared on behalf of the respondent company despite proper service of notice. The counsel for the respondent states that legible copy of the complaint is not received. The counsel for the respondent may collect legible copy of the complaint from the registry of the authority and shall file reply within a period of three weeks failing which the defence of the respondent may be struck off.   Matter to come up on 1.8.2024 for further proceedings.

As per the previous order dated 05.10.2023 respondent was directed to file reply within two weeks i.e. by 19.10.2023 in the registry with a copy to the complainant failing which cost of Rs. 5000/- shall be imposed upon the respondent. Further last opportunity was granted and it was made clear to the respondent that in case reply is not filed within the time allowed, the defence of respondent shall be struck off. Despite several calls none appeared on behalf of respondent and further till today neither reply filed on behalf of respondent within stipulated period nor paid cost of Rs. 5000/-. As respondent is not appearing to contest the present complaint and also not paying cost so now matter is listed before authority on 04.04.2024 for further proceedings.

Case has been called out but no one has appeared on behalf of the respondent today. Written reply has not been filed by the respondent so far. The counsel for the respondent requests for a short adjournment for filing of reply.  Respondents are directed to file reply within two weeks i.e., by 19.10.2023 in the registry with a copy to the complainant failing which cost of Rs.5000/- shall be imposed upon the respondent.  Last opportunity is being granted. In case reply is not filed within the time allowed, the defense of the respondent shall be struck-off. Matter to come up on 11.01.2024 for further proceedings.
