The present complaint was received on 02.02.2024 and the reply on behalf of respondent was received on 28.03.2024. The counsel for the complainant states that the main allottee has passed away and a copy of Will dated 02.08.2016 duly registered with the  sub Registrar, Gurugram in favour of Shri Nihal Singh son of deceased allottee. The complainant who is son of the deceased allottee states that the unit was allotted way back in 2016  but possession is not yet handed over despite having paid more than 95% of the consideration money and requests for allowing DPC and direction for handing over the possession.  The  occupation certificate has already been received.  The complainant further requests for allowing relief as already allowed  in CR No. 582/2022 decided on 18.11.2022.  The proxy counsel for the respondent states that counsel for the respondent is not available today, although during last proceedings also, last opportunity was given to the counsel for the respondent for put in appearance and argue the matter. No further adjournment is justified. The counsel for the respondent may file brief written submissions within 10 days after supplying a copy to the counsel for the complainant. Matter to come up on 10.10.2024 for pronouncement of orders.
