PERMINDER SINGH HUF AND PERMINDER KAUR vs ORRIS INFRASTRUCTURE PRIVATE LIMITED

The present complaint was filed on 06.02.2024 and registered as complaint no. 313 of 2024 and reply on behalf of respondent no.1 was received on 09.05.2024 along with application for dismissal of complaint u/o7 r11 of CPC. The proxy counsel for the complainant has supplied a copy of the reply to the application for dismissal of complaint to the counsel for the respondent and requests for an adjournment. Reply filed by the respondent no. 1 in the registry today taken on the record. Copy of reply also supplied to the learned counsel for the complainant. Despite calls none appeared on behalf of the respondents no. 2. Till today no application filed on behalf of the complainant for impleading Municipal Corporation Manesar as necessary party (as per order dated 28.03.2024). As reply filed by the contested party i.e. respondent no. 1 so matter is listed before the authority on 01.08.2024 for final arguments.

Memorandum of appearance filed on behalf of the respondent no. 1. Authority letter on behalf of the respondent also filed by Ms. Suman. Reply not filed on behalf of respondent no. 1 and 2. At this stage Ms. Suman Planning Executive appearing on behalf of respondent no. 2 submitted that the project in question does not fall within the jurisdiction of respondent no. 2 whereas project is situated within the jurisdiction of Manesar Municipal Corporation. Notice sent to the respondent no. 3 through email ([email protected]) duly served on 12.02.2024. Despite calls none appeared on behalf of the respondent n. 3.     Now the case is adjourned for 09.05.2024 for filing reply on behalf of respondent no. 1 and 2. In case complainant wants to implead Municipal Corporation/ Committee Manesar then application for that purpose be filed in the registry.
