The District Bar Association, Gurugram, vide resolution No.3573 dated 12.03.2025  has  requested to adjourn all the cases fixed for today in view of Holi Festival, 2025. In view of the above, the matter is adjourned to 24.04.2025  for the purpose already fixed.

The present complaint has been received on 09.02.2024 and registered as complaint bearing no. 158 of 2023 and reply on behalf of respondent received on 11.09.2024. The counsel for the complainant is to provide the date of execution of buyer’s agreement, as the BBA annexed with the complaint is undated. The proxy counsel for the respondent requests for an adjournment as the main arguing counsel is suffering from viral fever.  Request is allowed. It shall be the last opportunity. Matter to come up on 13.03.2025 for further proceedings.

Since the Hon’ble Member is on leave, hence, the matter is adjourned to 02.01.2025 for further proceedings.

The present complaint was filed on 09.02.2024 and registered as complaint no. 158 of 2024. As per the registry, complainant had sent a copy of complaint through speed post as well as through email and proof regarding having the delivery of the complaint made to the respondent is submitted by the complainants as available in the file. Ms. Urvashi proxy counsel requests for a short adjournment for filing of reply in the registry of the authority as a copy of reply is supplied to the counsel for the complainant during proceedings.  The respondent is directed to file reply in the registry within one week failing which defense of the respondent shall be struck off. Matter to come up  on 19.12.2024 for further proceedings.

As per order dated 28.03.2024 respondent was allowed to file reply within three weeks of the order failing which with cost of Rs. 5,000/- to be paid to the complainant. Admittedly till today neither reply filed by the respondent nor cost paid. Despite calls none appeared on behalf of the respondent. Now the matter is listed before the Authority on 05.09.2024 for final arguments.

Notice sent to the respondent through email ([email protected]) was duly served on 13.02.2024. Notice sent to the respondent through Post (EH076079527IN) duly served on 14.02.2024. Today despite calls none appeared on behalf of respondent. Now the case is adjourned for 30.05.2024. Respondent is hereby directed to file reply, if any, within three weeks of this order with the registry with advance copy to the complainant failing which with cost Rs. 5000/- to be paid to the complainant.
