NIF PRIVATE LIMITED vs RAMPRASTHA DEVELOPERS PRIVATE LIMITED

The present complaint was filed on 07.06.2021 and the reply on behalf of respondent no. 2 was received on 06.08.2021. Despite proper service of notice, the respondent no. 1 failed to put in appearance before the authority and has also failed to file reply. In view of the same, the matter is proceeded ex-parte against respondent no. 1.           On 31.08.2022, the complainant counsel requested to amend the relief sought and consequently, the complainant was directed to file an application for amendment of relief sought within 15 days with an advance copy to the respondent and the respondent was directed to file an amended reply within next 15 days from the date of receiving of the application. The complainant has filed an application on 01.09.2022, for amendment of the relief sought and the respondents have failed to file amended reply till date. The application for amendment is allowed. Matter to come up on 24.09.2024 for further proceedings.

Vide resolution No.3026 dated 22.03.2024 a request has been received from District Bar Association,  Gurugram that on account of “Hola” i.e. 0n 26.03.2024,  the Hon’ble High Court of Punjab & Haryana and District Court remains closed, hence,  the matter is adjourned to    02.07.2024   for the purpose as already fixed.

Coram  of full bench is not complete.  Hence the case is adjourned to  26.3.2024    for the purpose already fixed.

The present complaint was filed on 07.06.2021 and registered as complaint No. 2347 of 2021 and reply was received on 06.08.2021. Counsel for the complainant states that the cases of similar natur of M/s  Ramprashta Developers Pvt. Lt.d. is pending for  adjudication before full bench on 7.11.2023  and requests to take the above matter on that date. However, there are large number of cases listed on 7.11.2023, it would not be possible to take up the above matter on 7.11.2023. Matter to come up on 16.1.2024 before full bench for further proceedings.

The proxy counsel for the complainant requests for a short adjournment as the main counsel is not available today and is out of station. Shri Navneet Kumar Advocate has appeared on behalf of the respondent and states that the arguing counsel is stuck in very heavy traffic jam at Delhi /Noida and is unable to appear before the authority and requests for a short adjournment for  one  week. Keeping in view the circumstances explained above,  the matter is adjourned to 20.07.2023  for final arguments. It is made clear that no further adjournment shall be granted to the respondent.

Matter to come up on 13.7.2023 for further proceedings.

Due to administrative exigency, the matter is adjourned to 13.01.2023  for the purpose as already fixed.

The counsel for the complainant requests for filing of amended complaint. Heard. Request is allowed. He is directed to submit the amended complaint in the registry of the authority with an advance copy to the respondent within 15 days and the respondent shall file the reply of the amended complaint within next 15 days.               Matter to come up on 30.11.2022 for further proceedings.

Due to paucity of time,  matter could not be heard.                Adjourned to 31.08.2022 for further proceedings.

In view  of judgment dated 11.11.2021 in title- M/s Newtech Promoters and Developers Pvt Ltd. Vs State of UP & Ors. Etc. passed by the  Apex Court, this forum has no jurisdiction to adjudicate the complaint in hands.                              File be transferred to the Authority. Next date will be notified later on by the Authority. Reader is directed to send the file immediately.

Case was fixed for final arguments today. Sh. Navneet Kumar Proxy Counsel for respondent, filed an application seeking adjournment. It is submitted by learned proxy counsel  that main counsel  i.e. Ms. R. Gayathri Manasa Adv, could not appear today, having suffered injury on her ankle. She had gone to her  hometown in Andhra Pradesh to attend some personal property matter there, but suffered injury.                       The application is opposed by learned counsel for complainant stating that matter was fixed for final argument in July, but is being adjourned unnecessarily. On previous date, Shri  Saughat Singh Adv, appeared on behalf of respondent and sought adjournment.                        As  per Vakalatnama filed by respondent, the latter has authorized five advocates to represent it including  Ms. R. Gayathri Manasa Adv. Even if, Ms. R. Gayathri Manasa Adv, has suffered injury, anyone from other advocates could appear. Although I am not convinced with the plea taken by the respondent, in the interest of justice, one more opportunity is granted to the respondent for final arguments. It is made clear that no further adjournment will  be granted on reason mentioned above.                       To come on 30.11.2021 for final arguments.

It is submitted by the learned counsel for  respondent that he could not file written reply before this forum although copy of the same  has  already been supplied to the complainant. He seeks time to file written reply before this forum also. Not opposed. Allowed. Let written reply be filed within  10 days with advance copy to the complainant.  Although learned counsel for the complaint submits  that he is ready for  arguments but is not raising objection on the request of the respondent. 2.                   Let written reply be filed before the next date of hearing with an advance copy to the complainant. 3.                     To come on  19.10.2021 for arguments.
