Fresh vakalatnama filed on behalf of complainant by counsel Sh.
Complainant appearing in person along-with his counsel made a statement to the effect that the complainant is ready to handover his disputed vehicle to the opposite party no.
2 which is in the custody of opposite party no.
1, for its free of costs repairing in road worthy condition after giving test drive of the same.
It is further stated that I give my full consent as per the directions of the Hon’ble Commission to settle the present matter in afore-mentioned terms.
Learned counsel for the opposite party no.
2 Sh.
Devraj Singh Rana, Advocate made a statement to the effect that he being the counsel for opposite party no.
2 Tata Motors Ltd. and is fully authorized to settle the matter on behalf of the Tata Motors Ltd.
He agrees to the statement given by the complainant and ready to comply by the order passed by the Hon’ble Commission regarding the vehicle involved in the complaint bearing chasis no.
MAT810002L5J06740, Model Tata 709-G, which is parked in the workshop of opposite party no.
1 Pasco Motors, Faridabad.
Faridabad.
It is further stated that they will deliver the vehicle to the complainant at his entire satisfaction in road worthy condition after giving the test drive to the complainant free of costs as per the direction of the Hon’ble Commission.
Heard.
Keeping in view the statement made by the complainant and counsel for opposite party no.
2, it is directed to the opposite party no.
2 that it will repair the disputed vehicle free of costs which is parked in the workshop of opposite party no.
1 and after repairing deliver the same to the complainant at this entire satisfaction in road worthy condition after giving the test drive of the same to the complainant within a period of 45 days from the date of passing of this order.
However, it is made clear that in case the opposite party no.
2 fails to make the compliance of this order within a period of 45 days from the date of passing of this order, the complainant will be at liberty to file the execution against the opposite party no.
With these directions, the present complaint stands disposed off.
Certified copy of this order be provided to both the parties free of costs.
File be consigned to record room after due compliance.
