Pavana Murthy, learned counsel for the applicant and Sri S.M.
Patnaik, learned Standing Counsel for the respondents at length.
Learned counsel for the applicant submits that Provisional Pension and Gratuity have been granted to the applicant and hence, the inquiry against him may proceed as per Railway Service (Pension) Rules, 1993.
Accordingly, the stay earlier granted by this Tribunal also abates and is hereby vacated.
Let the inquiry process be carried on as per the relevant Rules in an expeditious manner and the applicant is also directed that he shall co-operate fully with the process of inquiry so that it is completed as per law in an expeditious manner.
The O.A. is disposed of accordingly.
