Justice Vijay Lakshmi, Member (J) Heard Shri Sachin Upadhyay, learned counsel for the applicant and Shri Chakrapani Vatsyayan, learned counsel for the respondents.

Perused the record.

At the very outset, learned counsel for the applicant submitted that applicant had filed a representation before the respondents for family pension and in reply to the same the Department on 7th January, 2020 had required certain documents, which have already been provided by the applicant.

The grievance of the applicant is that although she has supplied all the documents as required by the respondent vide letter dated 07.01.2020 and also moved a representation on 14.10.2020 to Page 2 of 2 the respondent No.3, but the respondents have not taken any decision on her representation till today.

Learned counsel for the applicant has prayed that the applicant will be satisfied at this stage, if the competent authority/respondent no.3, is directed to take a decision on her representation dated 14.10.2020 and to decide the same by a reasoned and speaking order, in time bound manner.

In view of the limited prayer made by learned counsel for the applicant, no fruitful purpose will be served in keeping this matter pending and it is disposed off finally at the admission stage with the direction to the competent authority/respondent No.3 to consider and decide the representation of the applicant dated 14.10.2020, pending before the respondents (copy whereof has been filed as Annexure A- 9 to the OA) in accordance with law and relevant rules, by a reasoned and speaking order, within a period of two months from the date of receipt of certified copy of this order.

The order so passed shall be communicated to the applicant without any delay.

With the aforesaid direction, the OA is finally disposed of at the admission stage.

It is made clear that the Tribunal has not expressed any opinion on the merits of the case.
