A.K.Dubey, Member (A) Aggrieved by the order of recovery on account of occupation of Hostel facilities and simultaneously drawing House Rent Allowance during his posting at Mumbai, the applicant has moved this OA seeking direction to the respondents to favourably consider the :: 2 :: O.A./63/2023 representation dated 22.08.2022 (Annexure A-1) he made to them for releasing him from the recovery.

It is the say of the applicant that in terms of para 3 of letter dated 30.08.2007 (Annexure A/2), he is entitled to avail House Rent Allowance while occupying the hostel facilities at the stipulated rate.

Learned counsel for the applicant brought to our notice that one such affected person had approached the Hon'ble High Court of Bombay where the matter is pending; irrespective to that, the department had administratively decided to refund the deduction made from him.

This matter pertains to the same issue, and stands on some footing.

At this stage, learned counsel for the applicant submits that he shall be satisfied, if the respondents are directed to dispose of the pending representation within the stipulated time and such disposal shall be in accordance with law, particularly, with reference of the circular dated 30.08.2007.

Accordingly, the OA is disposed of at the admission stage with a direction to the respondents/ competent authority to consider and decide the pending representation of the applicant dated 22.08.2022 (Annexure A/1).
